$9.75M Settlement Reached in Birth Injury Case

The mother of a girl born with cerebral palsy in Chicago recently reached a $9.75 million settlement in the botched delivery case.

The suit was filed against the hospital the child was born in and blamed the medical center for the severe brain injuries she is now living with.

Delivery Goes Wrong

According to court papers, Madeline Maturino, the daughter of Rosa Lopez, was born at Northwestern Memorial Hospital in 1998.

Maturino was born a week after her due date and doctors reportedly induced labor with a medication known as Pitocin.

However, too much of the drug was administered and Lopez began experiencing strong contractions too close together that put the baby at severe risk.

Doctors Fail to Realize Problems

Maturino claimed the doctors caring for her failed to recognize that her daughter was in distress until it was too late.

As a result, Maturino suffered from oxygen deprivation and has damaged brain tissue which led to her development of cerebral palsy.

“Every day is a challenge because she is greatly frustrated most of the time,” says Lopez. “She needs a lot of redirection and reminders.”

Settlement Compensates Family

Lopez says the settlement money will be used to get Madeline expanded therapy and treatment in a continued fight against the oxygen-deprivation injury she suffered.

Madeline is currently attending special-education classes, but has a speech disorder due to cerebral palsy.
