At the beginning of this week, a jury began attempting to make a decision on the four-year-old medical malpractice suit that has a doctor standing accused.
It is now up to the Clark County jury to decide whether or not an obstetrician and the hospital where he works is responsible for the disability of a child.
In 2003, Catherine Kesterson, 23 at the time, was overdue and delivered her 10-pound daughter at St.Mary's hospital.
Immediately following the surgery, Catherine and her husband questioned whether the hospital mishandled the delivery.
The lawsuit questions whether or not Dr. Walter Jarrett made the correct decision in inducing labor through drugs as opposed to performing a C-section.
When another doctor delivered Kyla more than 14 hours later, a C-section was finally performed and the infant was not breathing.
According to the suit, Kyla suffered from oxygen loss and began having seizures immediately after her delivery.
Kyla was diagnosed with cerebral palsy and is now confined to a wheelchair.
The Kesterson's are seeking more than $10,000 for their child's disability.
