$4M Settlement Reached in Fresno

A hospital in Fresno, California recently reached a settlement in the case against them involving a child who was delivered with cerebral palsy.

The delivery occurred over a decade ago, but the parents of the child were able to see justice served for their son’s disabilities.

Birth Injury Causes Cerebral Palsy

When Gabriela Enriquez gave birth to her son, Jose, at the Sierra View District Hospital, he had significant brain damage due to a lack of oxygen.

Jose is now living with cerebral palsy and although doctors believe his intellectual development may be normal, his motor skills are not.

Hospital Blamed for Disability

Enriquez filed the suit against Sierra View Hospital and blames the staff for her son’s health complications.

“Over the last several hours of labor, evidence on the fetal monitor demonstrated the baby was in distress, but that was ignored by nurses and the obstetrician on duty,” says her attorney, Bruce Fagel.

As a result of the hospital’s errors, Jose will never be able to walk or communicate normally.

Settlement Reached

Sierra View Hospital has agreed to pay $4 million to the mother and child affected by their mistakes.

The settlement also states that Jose will receive $45 million over his lifetime for his injuries.
