Malpractice Suit Settled for $15.35M

A settlement was recently reached in a medical malpractice case filed in Aurora, IL, for $15.35 million.

The suit was filed by the mother of a child who is living with cerebral palsy after he was born with brain damage.

Complications with Pregnancy

Vanessa Jenkins reportedly went into labor at Valley West Community Hospital in October of 2001.

During the delivery the doctor reportedly failed to successfully use the vacuum extractor device, which was needed to prevent brain injuries from occurring.

When doctors realized that the child’s heart rate was in distress, they were reportedly forced to do an emergency C-section.

Lawsuit Filed

Jenkins filed the medical malpractice lawsuit after her son, Cody Smithey, was born with cerebral palsy and mental retardation.

The money received from the settlement will reportedly go towards his past and future medical expenses as well as compensate for the pain and suffering that both the mother and son have endured.
