A Pennsylvania judge recently approved a $1 million settlement in a malpractice case involving a boy whose parents claimed doctor errors caused their son to develop cerebral palsy.
Darren and Jennifer Bryan, the boy’s parents, filed a cerebral palsy lawsuit in July 2004 against Dr. David Evans, Belvedere Medical Corporation, and Carlisle Area Health and Wellness Foundation. The suit was set to go to trial in November.
According to the parents’ complaint, the proper steps were not taken to prevent their son from suffering fetal distress, oxygen deprivation, and brain injury during his May 2001 delivery. As a result, the suit claimed that their son suffered severe physical and developmental disabilities.
Under the terms of the settlement, Evans and Belvedere were not required to admit liability. The third defendant was released from the suit prior to settlement.
The majority of the settlement money will be invested in a trust for the boy.
