Corey Lovett was born in May 2000 about 12 weeks prematurely at the Interfaith Medical Center in Brooklyn, New York. He suffered from neonatal respiratory distress syndrome. The Center's medical staff monitored his blood acidity and blood oxygen. The day after Corey's birth, the medical staff noted that his blood oxygen level had fallen sharply, and that he was suffering from a hemorrhage in his lungs.
A Brain Hemorrhage
The following day, medical imaging showed that Corey had experienced hydrocephalus and a brain hemorrhage, causing periventricular leukomalacia, destroying some of the white matter of his brain. This in turn caused Corey's cerebral palsy.
Corey's mother Vanessa Lovett later brought a medical malpractice lawsuit against the Interfaith Medical Center and the staff involved, contending that they had failed to properly monitor Corey's blood gas levels, causing the brain hemorrhage and cerebral palsy.
The Medical Malpractice Verdict
A verdict of $31,575,000 was awarded in November 2006 in New York Superior Court, King's County, as compensation for the costs associated with cerebral palsy care such as medical care, equipment, supplies, and home/facility care; future lost earnings; and pain and suffering.
