$19M Awarded to Mother and Son

A settlement was recently reached in New Jersey where a mother filed a suit after her son was born with cerebral palsy.

The suit was filed against the woman’s obstetrician who she claims is responsible for her son’s disabilities.

Pregnancy Goes Wrong

Bonnie Kowalski was admitted to Riverview Medical Center after complaining to her obstetrician, Dr. Aravind Palav, about abdominal pains.

Kowalski was reportedly only 30 weeks into her pregnancy when the complications began to occur.

When Palav ordered a surgeon to perform an appendectomy, thinking Kowalski was suffering from appendicitis, the doctor discovered an excess of blood in her abdomen.

Nurse Warns Doctor

Reports claim that a nurse warned Palav that the baby was in distress during this time but the doctor failed to take her concerns into account.

When a C-section was finally performed, Kowalski’s son, Brandon, had severe brain damage due to oxygen deprivation.

Suit Filed

In the cerebral palsy lawsuit, Kowalski says that Palav didn’t run proper tests on her to determine what was causing her abdominal pain.

Palav is also blamed for not listening to the nurse and improperly performing the C-section.
