A settlement was recently reached in the medical malpractice lawsuit that was filed by the parents of a son who was born with cerebral palsy.
The jury reportedly came to an agreement that a hospital delay was responsible for the child’s current disability.
Hospital Errors Cause Disability
During Jacob Tomlian’s birth in 1991, the heart-monitoring equipment reportedly showed fetal distress.
An emergency C-section was reportedly conducted on his mother Dora; however, according to Crane Johnstone, the attorney for the family, it wasn’t conducted early enough.
Settlement Reached
Tomlian was reportedly born with cerebral palsy as a result of the delayed procedure and also has deafness in one ear and a spastic gait.
Jurors decided that the hospital was 85 percent responsible and the doctor was 15 percent responsible for the child’s disability.
Westwood Regional Medical Center and Dr. Mark Grentiz were named as the defendants in the suit and both defendants are expected to pay the family a total of $30 million for their wrongdoing.
“I don’t think there’s been a bigger medical malpractice verdict in town,” says Johnston. “The family has waited 16 years. It’s kind of a big deal for them.”
